1. About Us

Pawtraitly is operated by Vertex AI Automations LLC ("we", "us", "our"). By placing an order or using this website you agree to these Terms of Service in full. If you do not agree, please do not use the service. You can reach us at support@pawtraitly.net or through our contact page.

2. Website Use

You agree to use this website for lawful purposes only. You must not attempt to disrupt the site's functionality, submit inaccurate order information, or use the service in any way that could harm us, other customers, or third parties. We reserve the right to update or modify website features at any time without notice.

3. Made-to-Order Products

All portraits are custom-made to your specifications. Because production begins shortly after your order is placed and payment is confirmed, please review your portrait selection, frame, and size carefully before checkout. We will notify you if a product becomes unavailable or if a pricing error is discovered, and will offer a full refund in those cases.

4. AI-Generated Portraits & Artwork Variation

Portraits are generated using AI technology applied to your uploaded pet photo. Because AI generation is inherently creative and non-deterministic, results will vary — the style, colour palette, and artistic interpretation of your portrait may differ from the source photo and from preview images. Watermarked previews shown on the results page are provided for selection purposes only; full-resolution prints may differ slightly in detail.

We make every reasonable effort to produce high-quality, accurate portraits. If your order arrives in a condition materially different from what was selected, our Returns & Refunds Policy applies.

Generation limit: AI portrait generation is limited to 5 free sessions per IP address per 24-hour period to prevent abuse.

5. Payment

All prices are in USD. Payments are processed securely through Stripe. We never store your full card details on our servers. Orders are confirmed once payment is successfully received. We reserve the right to cancel an order and issue a full refund if a material pricing error is discovered before fulfilment begins.

6. Shipping & Delivery

We ship to the United States and Canada. Estimated delivery is 5–7 business days after dispatch. Delivery timeframes are estimates and may vary due to factors outside our control, including carrier delays. Risk of loss passes to you upon handover to the carrier. We are not responsible for delays caused by shipping carriers or customs.

7. Cancellations, Returns & Refunds

Our full policy is at pawtraitly.net/returns. In summary:

• Orders may be cancelled before production begins — please contact us immediately if you need to cancel.
• Once production has started, we cannot accept change-of-mind cancellations as each portrait is custom-made.
• If your order arrives damaged, defective, or materially different from what you ordered, we will reprint or fully refund — your choice.
• Contact us within 14 days of delivery with a photo of the issue.

8. Digital Downloads

Digital pack purchases include high-resolution, watermark-free downloads of all AI portrait styles generated for your order. Download links are valid for 7 days from the date of purchase. If your link expires, contact us and we will issue a new one. Digital pack purchases are non-refundable once the download link has been delivered.

9. Your Content & Licence

You retain full ownership of photos you upload. By uploading, you grant us a limited, non-exclusive, royalty-free licence to use the photo solely to generate and fulfil your order. You confirm that you have the right to use any photo you upload and that it does not infringe any third-party rights.

Prohibited uploads: You must not upload images containing explicit or adult content, or photos of individuals who have not consented to their likeness being used. We reserve the right to cancel such orders without refund.

10. Intellectual Property

All website content, branding, and design elements are owned by Vertex AI Automations LLC and may not be reproduced or used without written permission. AI-generated portraits are produced for your personal use. You may print, display, and share them for personal purposes. Commercial resale of AI-generated portraits is not permitted without our written consent.

11. Limitation of Liability

We accept responsibility for reasonable product quality and customer service. We are not liable for delays caused by shipping carriers, issues arising from customer-provided information, or indirect and consequential damages of any kind. Our total liability shall not exceed the amount you paid for the order in dispute. Nothing in these Terms affects your statutory consumer rights.

12. Marketing Communications

If you opt in to marketing emails, you may unsubscribe at any time by clicking the unsubscribe link in any email. Opting out of marketing does not affect order confirmations, shipping notifications, or other transactional communications related to your purchase.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from or relating to these Terms or your use of the service shall be resolved in a court of competent jurisdiction. Nothing in these Terms limits your statutory rights as a consumer.

15. Changes to These Terms

We may update these Terms at any time. The "Last updated" date above will reflect the most recent revision. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
